Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the Reviewed platform, website and related services (the “Service”).
Reviewed is operated by Ellis Elrick and Olly Mitchell, trading as Reviewed.
By creating an account, starting a trial, accessing or using the Service, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use the Service.
Description of the Service
Reviewed is a software platform that helps businesses:
- request customer reviews;
- send review follow-ups;
- manage customer feedback;
- track review activity;
- monitor review performance; and
- automate related customer communication workflows.
Reviewed provides software tools only.
Reviewed does not guarantee:
- customer response rates;
- review volume;
- review ratings;
- Google rankings;
- enquiries;
- revenue; or
- business growth.
Results depend on factors outside our control, including customer behaviour, market conditions and third-party platforms.
Eligibility
You may only use the Service if:
- you are at least 18 years old;
- you are authorised to act on behalf of a business;
- all information you provide is accurate and up to date; and
- your use complies with applicable laws and regulations.
Licence Grant
Subject to compliance with these Terms, Reviewed grants you a limited, non-exclusive, non-transferable and revocable licence to access and use the Service for your internal business purposes.
No ownership rights are transferred to you.
All rights not expressly granted remain reserved by Reviewed.
Account Registration and Security
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity conducted under your account;
- ensuring only authorised users access your account;
- promptly notifying us of any unauthorised access or security incident.
We may suspend or restrict access where we reasonably believe an account has been compromised.
Acceptable Use
You must use Reviewed in accordance with our Acceptable Use Policy.
You must not:
- send spam or unsolicited communications;
- create fake reviews;
- engage in fraudulent or misleading activity;
- breach telecommunications or data protection laws;
- interfere with the operation of the Service;
- attempt to gain unauthorised access to systems or accounts;
- circumvent security measures or usage limits; or
- use the Service for unlawful purposes.
Breaches may result in suspension or termination of your account.
Customer Data and Compliance
You retain ownership of all customer data uploaded to the Service.
You are solely responsible for ensuring:
- customer information has been collected lawfully;
- required consents have been obtained;
- communications comply with applicable laws;
- customer data is accurate and up to date.
Reviewed processes customer information only for the purpose of providing the Service.
You remain responsible for your relationship with your customers.
Subscription and Billing
Subscription Plans
Reviewed operates on subscription plans. Current pricing is displayed on revieweditapp.com and may be updated from time to time.
Billing
Subscriptions are billed in advance on a monthly or annual basis. You authorise us and our payment providers to charge your selected payment method automatically.
Free Trials
Reviewed may offer free trials. Unless cancelled before the trial ends, the subscription will automatically convert into a paid subscription and the applicable fee will be charged.
Cancellation
You may cancel at any time through your account settings or by contacting support. Cancellation prevents future renewals but does not provide refunds for the current billing period.
Refunds
Fees are non-refundable except where required by applicable law.
Third-Party Services
The Service relies on third-party providers, which may include:
- Stripe;
- Twilio;
- Google;
- hosting providers;
- analytics providers; and
- other infrastructure providers.
We are not responsible for interruptions, outages, data loss, policy changes or actions taken by third-party providers.
Your use of third-party services may also be subject to their own terms and privacy policies.
Service Availability
We aim to keep the Service available and reliable. However, we do not guarantee:
- uninterrupted availability;
- continuous access;
- error-free operation; or
- compatibility with all devices or platforms.
The Service may occasionally be unavailable due to maintenance, updates, technical failures or third-party outages.
Intellectual Property
The Service, including software, source code, branding, trademarks, designs, content and functionality, is owned by Reviewed or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, reverse engineer, decompile or create derivative works without our prior written permission.
Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Reviewed disclaims all warranties, whether express or implied, including warranties relating to merchantability, fitness for a particular purpose, availability, accuracy and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, Reviewed shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, business opportunities, goodwill or data.
Our total liability arising from or relating to the Service shall not exceed the total fees paid by you to Reviewed during the twelve months immediately preceding the claim.
Nothing in these Terms excludes liability that cannot legally be excluded.
Termination
We may suspend, restrict or terminate access immediately if:
- you breach these Terms;
- you breach the Acceptable Use Policy;
- fraudulent or unlawful activity is suspected;
- required by law; or
- continued access creates risk to the platform or other users.
Upon termination, your right to use the Service ends immediately, access may be removed, and account data may be deleted in accordance with our retention policies.
Force Majeure
Reviewed shall not be liable for delays, failures or interruptions caused by events outside our reasonable control, including telecommunications failures, internet outages, cyberattacks, natural disasters, governmental actions, labour disputes or failures of third-party providers.
Changes to the Service
We may modify, improve, suspend or discontinue any part of the Service at any time.
We may also update pricing, functionality or features as the platform evolves.
Changes to These Terms
We may update these Terms from time to time. Material changes may be communicated through email, platform notifications or website notices.
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of England and Wales.
Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
